Breach of Trust: Nurse’s Breach of Patient Privacy Forces Elderly Woman out of Nursing Home
In a distressing incident last month, a 92-year-old resident of Edison, New Jersey, was abruptly forced to leave Embassy Manor at Edison Nursing and Rehabilitation Center due to an egregious violation of the Health Insurance Portability and Accountability Act (HIPAA). The incident has prompted formal complaints and investigations into the facility’s actions.
HIPAA Violation Unveiled: The Forced Exit
Late on the evening of January 23rd, several officers from the Edison Police Department responded to Embassy Manor at Edison Nursing and Rehabilitation Center following a complaint from the family of a resident. The complaint alleged that a nurse at the facility, identified as Rachell Ong, had disclosed private medical information about another patient—a recent admission recovering from COVID-19.
The affected patient, a 92-year-old woman who had previously undergone treatment at another facility and completed a ten-day quarantine, had been admitted to Embassy Manor for physical therapy. However, due to the HIPAA breach, she was compelled to leave temporarily. Only after the facility acknowledged the privacy violation did they relocate the patient to another room, allowing her to return. Despite this, the family chose to permanently remove her from the facility the following day.
Outrage and Disappointment: Family Speaks Out
Expressing their outrage, a family member of the elderly woman said, “I think it’s a disgrace that any nurse would divulge personal medical information to another patient’s family without any authorization to do so. How could anyone be so incompetent and unprofessional to violate a patient’s privacy?”
Facility Responds: Investigation Underway
Embassy Manor’s administrator, Michael Brienza, responded promptly to the incident, stating, “We are investigating the matter and comply with HIPAA regulations.” The breach not only raises concerns about patient confidentiality within the facility but also about the adequacy of training and protocols to safeguard sensitive medical information.
Formal Complaints and Investigations Initiated
In response to the gravity of the situation, the family of the victim has taken formal action. Complaints have been filed with the U.S. Department of Health and Human Services, the Office for Civil Rights, the State of New Jersey Department of Health, and the New Jersey Board of Nursing. Such violations of the Privacy Rule can result in criminal penalties, including fines of up to $50,000 and imprisonment for up to one year.
Conclusion: A Call for Accountability
This incident underscores the critical importance of safeguarding patient confidentiality. The fallout from this HIPAA violation has far-reaching consequences, not only for the elderly patient but also for the reputation and practices of Embassy Manor. As investigations unfold, the community awaits the results and expects accountability measures to be put in place to prevent such breaches in the future. Patient trust and well-being depend on the unwavering commitment to upholding the highest standards of healthcare ethics and privacy.

DON is the most caring person i have worked with. The Administrator gets rid of any employee accused off Abuse without properly finding out true or false. What 1199 have to do with anything when they are only told what someone is accused off.The building has new owners an bosses they don,t no the facility as the CNA,S who has been there so therefore they depend on the help of the CNA,S who in most times is able to defuse a situation. Therefore start looking at the owners first.
It’s disgraceful and disgusting that Jason M would even involve 1199. The union would never stand for any type of abuse! What reason would you involve the union on abuse allegations??
DON, administrator and union 1199 enable and sometimes encourage abuse and neglect. Truly awful place. They should relocate all 200 residents and close down for good
This facility is the worse in NJ they have rodents throughout the building. Staff have to put all their belongings in plastic bags and to make sure they don’t bring roaches home. Food be cold don’t arrive on time never enough linen for staff nor is there for diapers. This place is a disgrace and from the administration to the director of nursing they don’t care enough for theses residents nor their families. I can tell you more bout this facility but one thing for sure and two things for certain I wouldn’t put my dog there to live period.
Agreed. Union, DON and administrator enable abuse and neglect and do nothing to protect residents. Food is always cold. Nurses are decent. Rehab is excellent but CNAs control everything. It’s a travesty. War crimes is appropriate especially on weekends when staffing is abismal.
